Merlin - I believe this is a Merlin. He just caught another bird when I surprised him. I had to push the exposure a little because it was later in the evening. Have a great day - JY
Upon further investigation......A Cooper's Hawk. I guess the red eyes give it away. Thanks to mom4squirrels.

I wonder if they tend to visit the East Coast area, I'll have to ask Kim ;) Wonderful job capturing it, when viewed at X2 I saw the results of your pushing it a bit with your D80, a bit of noise but that can be simply corrected with Noiseware Pro or Noise Ninja if you have it JY. Such a beautiful photo would be a shame not to have a clean copy for yourself, if you don't have the necessary software I would be more then happy to apply it for you to clean it up, if you wanna email me the file. on April 4, 2009Great catch for both of you :-) If you want to make sure you're accurate in your labeling, check your bird guide, I believe this is a Cooper's Hawk (bird hawk). Cooper's have a red eye.
